1. Acceptance of these terms
These Terms of Service ("Terms") form a binding agreement between you and Lean Engineering LLC, operator of EasyMMC ("we", "us", "EasyMMC"). By creating an account, signing in, or otherwise using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What EasyMMC provides
EasyMMC is a software tool that helps mariners prepare paperwork for USCG captain's license applications and helps schools review and manage those packets. We are not a law firm, the United States Coast Guard, the National Maritime Center, or any government agency, and we do not provide legal, medical, or regulatory advice. You are solely responsible for the truthfulness and completeness of the information you submit and for delivering the finished packet to the USCG.
3. Accounts
You must be at least 16 years old to create an account. You agree to provide accurate information, keep your credentials confidential, and notify us promptly of any unauthorized use. You are responsible for activity that happens under your account.
4. School accounts and roles
School subscriptions are administered by an account holder who can invite other users and assign roles (admin, staff, instructor, viewer). The school account holder is responsible for the conduct of users they invite and for revoking access when a person leaves. Mariners' application data may be visible to authorized staff of the reviewing school.
5. Acceptable use
You agree not to:
- Submit fraudulent, misleading, or unlawful information through the Service.
- Impersonate another person or misuse another mariner's identity.
- Reverse engineer, scrape, or attempt to gain unauthorized access to the Service.
- Use the Service to violate any law, rule, or regulation, including USCG regulations.
- Upload malware, spam, or content that infringes another person's rights.
6. Fees, billing, and cancellation
School subscriptions are billed in advance on a monthly basis at the rate published on our Pricing page (currently USD $299 per month). Mariner accounts opened through a subscribing school are free for the mariner. We may change pricing on at least 30 days' notice for existing subscribers; the new price applies at your next renewal.
You may cancel your school subscription at any time from your admin settings; your access continues through the end of the paid period. Fees are non-refundable except where required by law. If a payment fails, we may suspend the school's access until payment is brought current.
7. Intellectual property
You retain all rights to the information you enter and the documents you upload ("Customer Content"). You grant us a limited, non-exclusive license to host, process, and display Customer Content solely to provide the Service to you and your school.
EasyMMC, its software, and its underlying intellectual property are owned by Captain John Littlefield (per our development agreement with Lean Engineering LLC) and are protected by copyright and other laws. You receive no rights to that software except the right to use the hosted Service under these Terms.
8. E-signature consent
When you draw or type your signature in the Service and apply it to a CG-719 form, you agree that your electronic signature is the legal equivalent of your handwritten signature under the U.S. ESIGN Act, and that you intend to sign the corresponding document. You can request a paper alternative by contacting your school.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific form output will be accepted by the USCG.
10. Limitation of liability
To the maximum extent permitted by law, neither EasyMMC nor Lean Engineering LLC will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, and (b) USD $100.
11. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
12. Termination and suspension
You may close your account at any time. We may suspend or terminate access if you materially violate these Terms, if your account creates a security risk, or if we are required to do so by law. On termination, sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, governing law) survive.
13. Changes
We may update these Terms from time to time. Material changes will be notified by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
14. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. The parties agree to bring any dispute exclusively in the state or federal courts located in Florida and consent to personal jurisdiction there. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.
